1. General Provisions and Mission

The "Chronicles of Busification" Platform (hereinafter referred to as the "Platform") constitutes an independent digital archive of documentary materials recording events of high public significance within the context of mobilization processes in Ukraine.

Legal Status of the Platform:

The Platform operates as a public information resource collecting and storing information in the public interest. The Platform's activities are aimed at realizing the citizens' right to receive reliable information regarding the activities of state institutions.

Intended Use of Materials:

  • Documentation of events for historical memory and academic research
  • Ensuring transparency of actions by authorized bodies
  • Facilitating human rights activities and monitoring human rights compliance
  • Providing verified data for investigative journalism

2. Information Collection Methodology (OSINT)

The Platform operates as an aggregator of information from open sources (Open Source Intelligence). We are not the primary publisher of the materials but perform their systematization and cataloging.

Data Sources:

Information collection is conducted exclusively from publicly available sources to which an unlimited circle of persons has legal access (social networks, video hosting sites, public communication channels).

Processing Principles:

  • The Platform does not employ methods of covert surveillance or unlawful interception of information.
  • Verification of materials is conducted using digital forensics methods to confirm their authenticity (absence of signs of editing, deepfakes).

3. Privacy Policy (GDPR)

Data processing is carried out in accordance with the General Data Protection Regulation (GDPR, EU Regulation 2016/679).

Measures to Protect Data Subject Rights:

To balance the right to information with the right to privacy, the Platform applies the following measures:

Rights of Data Subjects:

Persons captured in the materials have the right to exercise their rights under Chapter III of the GDPR, including the right to erasure ("right to be forgotten"), by submitting a reasoned request.

  • Art. 6(1)(f) GDPR: Processing is necessary for the purposes of legitimate interests (public interest in information).
  • Art. 85 GDPR: Processing for journalistic purposes and the purposes of academic, artistic, or literary expression.
  • Anonymization (depersonalization) of third parties who are not public figures or officials on duty.
  • Masking of personal identifiers (license plates, documents) if they do not have evidentiary value.

4. Copyright and Fair Use

The use of third-party materials on the Platform is based on the principles of Fair Use and citation.

Legal Framework:

Content Status:

The Platform does not claim authorship of the aggregated video materials. Copyrights to original content (design, texts, database structure, analytics) belong to the Platform.

  • Art. 10(1) of the Berne Convention: Permissible to make quotations from a work which has already been lawfully made available to the public, provided that their making is compatible with fair practice.
  • Art. 5(3)(c) and (d) of Directive 2001/29/EC: Use for the purpose of reporting current events and quotations for purposes such as criticism or review.

5. Legal Basis for Operations

The Platform's activities are protected by international norms guaranteeing freedom of speech and information:

Right to Film Officials:

According to ECHR case law, public officials acting in their official capacity have a reduced expectation of privacy. Recording their actions in public places is a legitimate form of civil oversight.

  • Article 10 of the European Convention on Human Rights (ECHR)
  • Article 11 of the Charter of Fundamental Rights of the European Union

6. Limitation of Liability (Disclaimer)

Disclaimer of Liability for Content: The Platform acts as an Information Society Service Provider. The Administration is not responsible for the content of materials created by third parties, nor for the veracity of statements made by event participants. Absence of Legal Qualification: Terms such as "violation," "crime," "illegal" used in descriptions or tags are value judgments or citations of primary sources and cannot be considered as facts established by a court. The Platform does not substitute for judicial or law enforcement bodies. Age Restrictions: Content may contain scenes of violence, profanity, or other 18+ materials. Access by minors to the Platform is not recommended.

7. Archiving and Evidentiary Basis

Storage Standards: Materials are archived in compliance with Chain of Custody standards to ensure their admissibility as evidence in future legal proceedings. Hashing technologies (SHA-256) are used to fix file integrity. Data Provision: The Platform is ready to cooperate with Joint Investigation Teams (JIT), the International Criminal Court (ICC), and human rights organizations by providing access to archives upon official request.

8. Contact Information and Notice and Takedown Procedure

To send legally significant communications, including copyright infringement notifications (DMCA) or requests for personal data removal (GDPR), please use the address: [email protected] Review Procedure: Requests are reviewed by the Platform's legal department. The response time is up to 30 days, unless otherwise provided by mandatory norms of applicable law. Anonymous requests that do not contain sufficient data to identify the material or the applicant may be left without consideration.

9. Applicable Law and Dispute Resolution

Applicable Law: The Platform's activities are governed by the laws of the Kingdom of the Netherlands, taking into account applicable norms of international law. Jurisdiction: Any disputes arising in connection with the use of the Platform shall be resolved in the competent courts of The Hague (Netherlands). The user agrees to the exclusive jurisdiction of these courts.

10. Final Provisions

If any provision of this document is found to be invalid by a court of competent jurisdiction, this shall not entail the invalidity of the remaining provisions. The invalid provision shall be replaced by a provision that is closest in meaning and permissible under the law.

11. Changes to Terms

The Administration reserves the right to amend this document without prior notice. The current version is always available on this page. Continued use of the Platform after changes are made constitutes acceptance of the new edition.
